Jurisdiction of Canadian Transportation Agency Affirmed – International Law Office

On October 13 2010 the Federal Court released its reasons for setting aside a decision of the Canadian Human Rights Tribunal, which in turn had issued
a decision inconsistent with a prior decision of the Canadian Transportation Agency dealing with the same passenger complaint.

The Federal Court found that Parliament intended that the agency should handle certain disability-related complaints, and that within this category of complaint the apparatus defined by the Canadian Human Rights Act does not provide an alternative recourse.
